Terms of Service
Effective date: March 21, 2026
These Terms of Service govern access to and use of the ArkNet platform, including the ArkNet website, console, registry, package publishing surfaces, provider onboarding and provider operations interfaces, and related APIs, software, and network services offered by ArkNet Inc.
1. Acceptance of these terms
By accessing or using ArkNet, you agree to be bound by these Terms. If you are using ArkNet on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity, and references to “you” mean that entity.
If you do not agree to these Terms, you must not access or use ArkNet.
2. The ArkNet services
ArkNet provides infrastructure and software services for package publishing, package resolution, provider coordination, compute routing, provider lifecycle management, billing-related token and reservation flows, and other control-plane and operational workflows.

- registry and package publishing services
- provider onboarding and provider state management
- authentication, authorization, and session management
- usage tracking, billing, and related operational tooling
ArkNet may add, remove, improve, or modify features over time. Some functionality may be designated beta, preview, limited availability, or experimental.
3. Eligibility and account access
You must be legally capable of entering into a binding agreement to use ArkNet. You are responsible for all activity that occurs through your account, organization, namespace, API credentials, or provider identity.

- promptly notify ArkNet of unauthorized access or suspected compromise
- use only identities and accounts you are authorized to use
4. Authentication and security
ArkNet may support multiple authentication methods, including third-party OAuth providers, session-based console access, API tokens, and provider identity verification mechanisms. You must not attempt to bypass, disable, probe, or undermine any authentication or security controls.
You are responsible for maintaining the confidentiality of credentials, private keys, tokens, session access, and any other authentication materials under your control.
5. Provider participation
If you operate as a provider on ArkNet, you are responsible for the infrastructure, configuration, performance, legality, and security of the systems you connect to the network.

- you must not misrepresent capacity, pricing, region, hardware, or availability
- you must comply with all technical and operational requirements published by ArkNet
ArkNet may suspend, limit, or remove provider participation where it reasonably believes a provider is misconfigured, unsafe, fraudulent, unavailable, non-compliant, or harmful to the network or its users.
6. Packages, artifacts, and user content
You retain ownership of packages, artifacts, metadata, prompts, source material, configurations, and other content you submit to ArkNet, except to the extent rights are needed for ArkNet to operate the services.
You grant ArkNet a non-exclusive, worldwide, limited license to host, store, process, reproduce, transmit, and display your content as needed to operate, secure, improve, and support ArkNet.
You must not upload, publish, distribute, or make available content that is unlawful, infringing, malicious, deceptive, or harmful to users, providers, ArkNet systems, or third parties.
7. Acceptable use
You must not use ArkNet to:
- violate law, regulation, sanctions, or third-party rights
- distribute malware, spyware, backdoors, or malicious payloads
- attempt unauthorized access to systems, accounts, data, or traffic
- interfere with, disrupt, degrade, or abuse ArkNet or provider infrastructure
- misrepresent identity, source, authorization, or operational state
- reverse engineer, scrape, or extract data in violation of applicable restrictions
- circumvent quotas, billing controls, usage controls, or security restrictions
8. Billing, fees, and usage
Some ArkNet features may require payment, funded balances, usage-based billing, reserved tokens, or other billing and settlement mechanisms. You agree to pay all applicable fees, charges, taxes, and assessments associated with your use of paid services.
Usage calculations, reservation flows, ticket issuance, settlement records, and related billing data generated by ArkNet will control in the event of a dispute unless you demonstrate material error.
Except where required by law or expressly stated otherwise, fees are non-refundable.
9. Availability and service changes
ArkNet works to operate a reliable platform, but it does not guarantee uninterrupted availability, universal provider availability, specific routing outcomes, specific pricing, or error-free operation unless otherwise expressly agreed in writing.
ArkNet may perform maintenance, impose limits, change technical requirements, modify features, or suspend access where necessary for security, compliance, integrity, operational stability, or abuse prevention.
10. Intellectual property
ArkNet and its associated software, designs, documentation, branding, interfaces, and service elements are owned by ArkNet Inc. or its licensors and are protected by intellectual property laws.
These Terms do not transfer ownership of ArkNet intellectual property to you. Subject to these Terms, ArkNet grants you a limited, non-exclusive, non-transferable, revocable right to access and use the services.
11. Suspension and termination
ArkNet may suspend or terminate access immediately if it reasonably believes you have violated these Terms, created security risk, caused harm, exposed ArkNet or others to liability, or used the services in a fraudulent, unlawful, or abusive manner.
You may stop using ArkNet at any time. Provisions that by their nature should survive termination will survive, including provisions relating to ownership, payment, disclaimers, limitations of liability, and dispute resolution.
12. Disclaimers
ArkNet is provided on an “as is” and “as available” basis, to the maximum extent permitted by law. ArkNet disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
ArkNet does not warrant that the services will be uninterrupted, error-free, secure against all possible threats, or suitable for every workload, jurisdiction, or compliance requirement.
13. Limitation of liability
To the maximum extent permitted by law, ArkNet Inc. and its affiliates, officers, employees, contractors, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to these Terms or your use of ArkNet.
To the maximum extent permitted by law, the total aggregate liability of ArkNet for all claims arising out of or related to these Terms or the services will not exceed the greater of: (a) the amount you paid to ArkNet for the applicable services during the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
14. Indemnity
You will defend, indemnify, and hold harmless ArkNet Inc. and its affiliates, officers, employees, contractors, and licensors from and against claims, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your use of ArkNet
- your content, packages, artifacts, or provider operations
- your violation of these Terms
- your violation of law or third-party rights
15. Changes to these terms
ArkNet may update these Terms from time to time. If a change is material, ArkNet will provide notice by updating the effective date, posting notice through the services, or using other reasonable means.
Your continued use of ArkNet after the updated Terms become effective constitutes acceptance of the updated Terms.
16. General
- These Terms are the entire agreement between you and ArkNet regarding the services, unless superseded by a written agreement.
- If any provision is held unenforceable, the remaining provisions remain in effect.
- Failure to enforce any provision is not a waiver.
- You may not assign these Terms without ArkNet’s prior written consent. ArkNet may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
